California Trucker Seeks $60 Million following Horrific Crash

Lancaster, CAA back and neck injury complaint is going forward under a black cloud of sorrow given the tragic death of one of the proponents of the incident. It also remains a tragic irony that the death ultimately led to the lawsuit in the first place.

The San Luis Obispo Tribune of California reported March 9 on the fate of Jose Hernandez Estrada, 56. According to the report, Estrada was driving a tractor-trailer along Highway 101 when a car driven by Jesus Landeros Valenzuela crossed from the opposite direction of the freeway and drove his car head-on into the path of the Estrada vehicle.

Landeros died instantly in the wreck, and the California Highway Patrol (CHP) ruled the death a suicide. There is no median located at that section of the highway, and there appeared to be no mechanical problem with the Valenzuela car, which was a rental. Thus, the CHP found that Valenzuela deliberately veered the car he was driving directly into the path of the large transport truck.

Back injury lawsuits are launched for a host of various reasons. In this case, lingering headaches together with severe neck and back pain coupled with shock have allegedly prevented Estrada from working.

He has launched a $60 million neck injury compensation lawsuit against the estate of the late Valenzuela, his employer Villa Automotive of San Luis Obispo, and Enterprise Rent-A-Car, which supplied the Sebring Valenzuela was driving at the time of the crash.

The state of California is also named as a defendant in the back injury compensation claim, citing less than ideal conditions inherent with the roadway.

The horrific accident occurred on January 31 of last year. The Estrada lawsuit was filed this past January, on the 26th in San Luis Obispo Superior Court.

According to lawsuit documents, Valenzuela was "on the clock" with his employer, Villa Automotive, at the time of the crash. It is further alleged that Valenzuela was also doing work for Enterprise Rent-A-Car. Valenzuela is reported to have checked into work at Villa Automotive at 7:45 am the day of the crash. The accident occurred later that day. Employees at Villa Automotive were apparently unaware that Valenzuela, who was married with two daughters and was considered a model employee, had left the workplace.

Estrada has been "unable to perform work, services and duties as a spouse...and will be unable to perform same in the future," according to his lawyers with the R. Rex Parris Law Firm in Lancaster.
