Late Floridian Man Wins $14 Million in Asbestos Lawsuit

Miami, FL: The family of a Florida man who died of complications from mesothelioma has been awarded more than $14 million by a Miami-Dade jury in a recent asbestos lawsuit against the chemical manufacturer Union Carbide (UC).

Late Floridian Man Wins Million in Asbestos LawsuitWilliam Aubin owned and operated a construction firm that used UC's products regularly for more than 40 years. The products, which contained trace amounts of the dangerous mineral asbestos, were never labeled as containing hazardous materials, according to the Aubin family's legal counsel, Juan Bauta.

Aubin eventually developed peritoneal mesothelioma from his exposure to asbestos and was left permanently impaired until the day he died, according to official reports.

Asbestos fibers were commonly used in construction until the EPA began to regulate its use in the 1970s after numerous individuals who had been exposed to the mineral began to suffer serious health issues like lung cancer, asbestosis and malignant mesothelioma. Mesothelioma is nearly always fatal and can lie dormant in one's system for up to 50 years.

The jury sided with the Aubins, claiming that UC was negligent for selling asbestos-laden products without warning that the material was present. In addition, the jury found that four of the compound manufacturers selling UC's products were also liable for Aubin's death.
